Construction Supervision of the  works on Zenica – Travnik Gas Pipeline

This request for expressions of interest follows the general procurement notice for the BH Gas d.o.o. Sarajevo, Central Bosnia Gasification Project that appeared on the EBRD website on 8 Apr 2010.

The European Bank for Reconstruction and Development (EBRD or the Bank) has made available to BH-Gas d.o.o. Sarajevo a loan for a project to construct a high-pressure gas pipeline, and related infrastructure, in Central Bosnia Canton enabling gasification of four municipalities – Busovaca, Vitez, Novi Travnik and Travnik.

The proposed project comprises a 37 km (approx.) DN400 high pressure gas transport pipeline together with associated infrastructure (the “Pipeline”). This includes pig launching and receiving stations (2 nr), block stations (3 nr), metering and pressure regulation stations (MRS) to serve each municipality, two connected DN200 branch pipelines with a total length of 7 km (approx).  The pipes will be high frequency induction longitudinally welded steel line pipe to API 5L (DN 400 X60 / DN 200 X52) with protective coatings PE (polyethylene), PP (Polypropylene), and IEC (Internal Epoxy Coating). The pipes will be supplied as free issue materials by the Employer via a goods supply contract that is financed under the same EBRD loan, the remain plant and materials will be supplied through the Works contract. The pipeline is to be installed in a predominantly wooded and hilly area, and there will some crossings of services, roads and water courses. Up to two of the crossings are to be carried out using horizontal directional drilling.

The objective of the Construction Supervision services is to supervise all works for the construction of the gas pipeline, and associated infrastructure, through efficient and effective expertise, resulting in the issue of a Taking-over Certificate for the Pipeline at the end of construction period.  The consultant shall also provide services during the Defects Notification Period and issue the Performance Certificate. In addition the consultant shall ensure that the requirements for supervision and handover of construction projects specified in B&H law are met.

The consultant will be required to undertake the role of the “Engineer” as defined in the FIDIC MDB Harmonised Edition of the Conditions of Contract for Construction, March 2006 and its outputs shall comply with current local Laws and regulation concerning construction, supervision, works quality control and environmental protection (Law on Spatial Planning and Land Utilization at the Level of the Federation of Bosnia and Herzegovina, Law of Environmental Protection of Federation of B&H, etc.)

The Services to be provided by the Consultant shall be for a construction period of about one year plus the Defects Notification Period of 12 months. The contract for the provision of supervision services is expected to start not earlier than July 2011.

The services shall include, but not be limited to:

.

  • establishment of systems of managerial control for the works contract,
  • the Engineer’s administration of Contract,
  • control over estimated works quantities and contract outcome costs,in
    monitoring the progress of the Works and technical records;
  • control and acceptance of Contractor’s interim and final payment certificates;
  • the acceptance and/or approval of Contractors’ proposed staff, licenses, programs, method statements, safety measures, supplies of plant and materials for incorporation in the works in accordance with specifications, the quality assurance and control plans, laboratory provisions and execution of the testing program, subcontractors, and Contractor’s equipment;
  • direct supervision of the works and monitoring of progress;
  • the preparation of progress, technical and contractual reports,
  • supervision of the quality control tests of: all plant and materials intended for incorporation into permanent works and all the executed works
  • monitoring of the contractor's compliance to an environmental management plan meeting EBRD and National standards.
    The language of the contract shall be English, but project documents required under national legislation will have to be submitted in one of the official languages of B&H and English.

The BH Gas d.o.o. Sarajevo now invites eligible consultants to indicate their interest in providing the above-mentioned services. Interested consultants must provide information indicating that they are qualified to perform the services. This invitation shall be followed by a short listing of consulting firms and the short listed firms will be formally invited to submit proposals. Consultants may associate to enhance their qualifications, in which case the leading consultant shall be indicated. Further, international and local or regional companies may wish to associate ensure they have the appropriate degree of experience. It will be considered an advantage for tenderers to have had experience of gas utility work in the Western Balkan region.

According to effective legislation of Federation of BiH, in particular Decree on Construction Site Organization, Necessary Documents on the Site and Participants in Construction (‘’Official gazette of the Federation B&H’’ No. 48/09)[1] http://www.fmpu.gov.ba/, construction supervision can only be performed by a legal entity registered and licensed for activities of designing and/or construction according to the scope of the Contract from the respective Federal Ministry. This legislation is applicable individually to each member of a joint venture, association or consortium (JVCA) and subcontractors. According to above mentioned decree, individual experts can only be hired trough agreement with registered and licensed legal entity. Companies without a licence from the respective Federal Ministry may be included in the list of firms invited to submit proposals for the construction supervision; however if successful they will not be awarded the contract if they do not posses the relevant licence at the time of tender submission.

.

Geotechnical supervision can only be performed by a legal entity licensed from the Federal ministry of physical planning according to Regulations on geotechnical survey and testing (“Official Gazette of Federation B&H” No. 60/09).

.

The consultant must have a good knowledge and understanding of the EBRD environmental and social Performance Requirements under the 2003 Environmental and Social Policy of the EBRD as well as a demonstrated experience of previous work with International Financing Institutions (IFIs) and gas utilities in the Europe.

.

In order to determine the capability and experience of consulting firms seeking to be short-listed for this Assignment the information submitted should include the following in English language

.

     a) Completed contact sheet, the template for which is available from the following web-link:

     b) Company profile(name, legal status, address, telephone number, fax number, e-mail, year of establishment), organisation and staffing (number of permanent and temporary employed staff, fields of expertise). In the case of a joint venture, consortium or association (JVCA), then the details shall be provided for all companies. The lead company, JVCA structure, and the role of each partner within the JVCA, shall be defined and notarised copy of certificate of incorporation from the relevant trade registry. In case of JVCA, legal basis of incorporation.

.

     c) Audited balance sheets or if not required by the law of the Applicant’s country, other financial statements acceptable to the Employer, for the last five (5) years (2006-2010) to demonstrate the current soundness of the Applicant’s financial position and its prospective long term profitability, and Applicant’s net worth calculated as the difference between total assets and total liabilities should be positive. These documents must be provided as notarized copies of originals, and for those documents that are not originally in English, only relevant extracts which will provide enough information for the verification of the selection criteria must be submitted in English language. As a minimum average annual turnover of the company (Single entity or JVCA as a whole) should be not less than Euro 3 million equivalent (in case of a JVCA, the Lead Partner shall meet not less than 60% of the requirement).

     d) Details of firm's general experience undertaken in the previous five years, including information on contracting entity/client, project location/country, duration (mm/yy to mm/yy), expert months provided (if different from duration), main activities, objectives. In the case of a JVCA details of experience shall be submitted by each partner, and shall be relevant to its anticipated role in the JVCA as set out in (b) above;

     e) Evidence of specific experience (by a single entity or a JVCA as a whole, in the case of a JVCA the Lead Partner must meet at least 80% of the requirement) as follows:


• Construction supervision of at least 150 km of high pressure (at least 50 Bar) gas pipeline of at least DN400 within the past 10 years, with indicated confirmation by the Client(s)

.

    f) According to the effective national legislation, laws and sub-legal acts, and in connection with the Law1, construction supervision activities must be covered with the following phases:

.

1. civil,

.

2. welding,

.

3. mechanical,

.

4. electrical (power supply and cathodic protection),

.

5. instrumentation control,

.

6. topographic survey,

.

7. geology,

.

8. health and safety at work,

.

9. fire protection and

.

10. environmental protection.

.

Evidence that the Company can provide staff with relevant expertise, for all the above listed phases, in accordance with the Decree and Regulation of national legislation before mentioned. In the case of a JVCA the Lead Partner must provide, at least, a Supervision Coordinator (to act as the Engineer in a FIDIC Contract) and staff for mechanical or civil phases;

     g) CVs of suitably qualified and experienced staff pointing out the same or similar infrastructure projects, who could have available to work on the Assignment in roles seen as key to the assignment by the Applicant (max 2 pages/CV) and must be provided for all staff for the above mentioned phases under (6).

Requirements for the key staff under phases 1, 2, 3 and 7 are as follows:

.

• total work experience – at least 10 years;
• specific work experience – at least 5 years.


     h) Evidence that the Applicant (or in the case of a JVCA, the Lead Partner) operates a quality management system certified to ISO 9001

.

     i) In the case of a joint venture, consortium or association (JVCA), requested information shall be provided for all companies. The lead company, JVCA structure, and the role of each partner within the JVCA, shall be clearly defined;

.

The criteria according to which the applicants will be selected for the short list will be requirements met under (c), (e) and (g).

The information presented by the consultant is to be in English and should not exceed 25 pages excluding CVs, financial details and contact sheet. All required information should be provided in resume form reflecting all above specified technical, financial and other requests.

This Invitation for Tenders follows the General Procurement Notice for this project which was published on the EBRD Web Site, Procurement Opportunities on 8 April 2010.

BH-Gas D.O.O. Sarajevo hereinafter referred to as the Purchaser, intends to use part of the proceeds of a loan from the European Bank for Reconstruction and Development (the Bank) towards the cost of Gasification of Central Bosnia Canton.

The Purchaser now invites sealed tenders from Suppliers for the following contract to be funded from part of the proceeds of the loan:

Goods Supply:

38770/01 Supply of Line Pipe

.

The Goods comprise:

.

¡ approximately 37 km of high frequency induction (HFWI) longitudinally welded steel line pipe DN400 (16 inch) to API 5L X60M PSL2, Polyethylene/polypropylene coated and epoxy lined (PE/PP + IEC)

.

¡ approximately 7km of high frequency induction (HFWI) longitudinally welded steel line pipe DN200 (8 inch) to API 5L X52M PSL2, Polyethylene/polypropylene coated and epoxy lined (PE/PP + IEC)

.

¡ 300m of longitudinally submerged arc welded (SAW) steel line pipe DN700 API 5L X52M PSL2, bare steel.

.

The Goods shall be produced by one manufacturer. The lining and coating shall be applied at the factory where the pipes are manufactured. Testing and Inspection of the Line Pipe materials during manufacture will be the responsibility of the Line Pipe Manufacturer. The manufacturer shall provide facilities for Independent / Third Party Inspection and / or any witnessing required by the Purchaser and allow the Purchaser and / or it’s representatives to visit the factory, therefore inspection shall be in accordance with EN 10204 type 3.2.. Third party inspection is to be carried out fully in accordance with the plan of quality control and production plan agreed and approved by the Purchaser at the meeting organized by manufacturer before the start of production.

The Goods are to be delivered DDU to Zenica. Delivery shall be in accordance with a Contract delivery Schedule Agreed with the Purchaser. It is expected the contract will be awarded early 2011 and delivery will start about July 2011 and be completed by October 2011.

.

Tendering for contracts that are to be financed with the proceeds of a loan from the Bank is open to firms and joint ventures (JVCA) from any country who have purchased the tender documents. In the case of JVCA the Lead partner shall have purchased the tender document. Tenders of those Tenderers who have not purchased the tender document will be rejected and returned unopened.

To be qualified for the award of a contract, Tenderers such as manufacturers or suppliers under an appropriate manufacturer’s authorisation must satisfy the following minimum criteria:

.

  • Average Annual Turnover in the last five years of not less than Euro 20 million equivalent;

.

  • Financial resources of not less than Euro 4.5 million equivalent;

.

  • Has manufacturing plant for a production capacity of at least 1500 m per day high frequency induction (HFWI) welded pipes;

.

  • Has manufactured and delivered at least 2000 km of HFWI welded steel pipes with DN from 200 to 400 in the last 5 years of which at least 200km shall have external PE/PP coating and internal epoxy lining;

.

  • Has the following certification: ISO 9001, ISO 14001, OHSAS 18001 either equivalent or higher quality assurance system with confirmation issued by Certification Body;

.

  • Has the Authority to use the Official API Monogram.

BH-Gas d.o.o. Sarajevo (the Employer) intends applying the proceeds of a loan from the European Bank for Reconstruction and Development [the Bank] towards the cost of Gasification of Central Bosnia Canton.

The Employer intends prequalifying firms and joint ventures, consortia or associations (JVCA) to tender for the following contract to be funded from part of the proceeds of the loan:

Contract 38770/02   Pipeline Construction

.

 This contract involves the construction of a DN400 (16 inch), 37 km (approx) high pressure steel gas transmission pipeline and 7 km (approx) of DN200 (8 inch) steel branch lines to enable gasification of four municipalities in Central Bosnia Canton by supplying gas to the towns of Busovaca, Vitez, Novi Travnik and Travnik. The pipes (according to API 5L), will be supplied by the Employer as Free Issue materials in Zenica, the remainder of the plant and materials will be supplied through this Works contract. The contract will be a combination of remeasurable items and lump sum prices under the FIDIC-MDB Harmonised Edition of the Conditions of Contract for Construction March 2006 all as defined in the Construction tender documents. The Tender Documents will be the Bank’s Standard Tender Document for Works, March 2010.  The Employer will remain responsible for the quality of Free Issue materials supplied to the Works Contractor, all as further described in Pre-Qualification Data, para 1.2.

 Tenderers  may be allowed to submit alternative tenders.

 It is expected the contract may be awarded in March 2011 and construction completed by after 12 months; the defects liability period will be 12 months.

Application for prequalification for the contract, which is to be financed with the proceeds of a loan from the Bank, is open to firms and joint ventures of firms (JVCA) from any country and who have purchased the prequalification documents.

According to effective legislation of Federation of BiH, in particular Decree on Construction Site Organization, Necessary Documents on the Site and Participants in Construction (www.fmpu.gov.ba), construction and certain construction related works and activities can only be performed by the legal entity that is registered for performing that activity and which owns license from the respective Federal Ministry. This legislation is applicable individually to each member of a joint venture, association or consortium.

 Companies, including all members of joint ventures, consortia, or associations (JVCA), meeting the qualification requirements but without a license from the respective Federal Ministry may be included in the list of firms invited to tender for the works; however if successful they will not be awarded the contract if they do not posses the relevant license at the time of tender submission.

BH-Gas intends to use the proceeds of a loan from the European Bank for Reconstruction and Development („EBRD“) and its own resources towards the costs of high-pressure gas pipeline construction in Central Bosnia Canton enabling gasification of 4 municipalities - Travnik, Vitez, Busovaca, Novi Travnik - in this Canton.

The proposed project has an estimated cost of EUR 17,0 million, proposed to be financed by the EBRD, and will require the following deliveries and construction services:

A. Line Pipe Supply: Delivery of steel pipes for high pressure gas pipeline, which are DN 400 (16”, cca 41 km) and DN 200 (8”, cca 7 km)
B. Basic Equipment Supply: 4 block stations, 2 Pig Launcher/Receiver Stations

Prequalification for all of the above contracts is expected to begin by the end of second quarter 2010.

Contracts to be financed with the proceeds of a loan from the EBRD will be subject to its Procurement Policies and Rules and will be open to firms from any country. The proceeds of the EBRD's loan will not be used for the purpose of any payment to persons or entities, or for any import of goods, if such payment or import is prohibited by a decision of the United Nations Security Council taken under Chapter VII of the Chapter of the United Nations or under a law of official regulation of the purchaser's country.
